YOUR ROOM Accommodation Terms and Conditions

Article 1 Scope of Application

1. Accommodation contracts and related contracts concluded between YOUR ROOM (hereinafter referred to as "this hotel"), a shared lodging facility operated by Nakano Design Works LLC (hereinafter referred to as "our company"), and users of this hotel shall be governed by these terms and conditions, and any matters not stipulated in these terms and conditions shall be governed by laws, regulations, etc. (meaning laws or those based on laws and regulations; the same applies below) or generally established customs.

 

2. In the event that the Hotel enters into a special agreement with respect to a Guest, provided such special agreement does not violate laws, regulations, or customary practices, notwithstanding the provisions of the preceding paragraph, such special agreement shall take precedence.

Article 2 Application for Accommodation Contract

1. Anyone who wishes to apply for an accommodation contract with our hotel must provide our hotel with the following particulars:

①Name, address, date of birth, phone number, email address, occupation, date of stay, expected time of arrival

② For those who are not Japanese nationals, nationality, passport number, previous and subsequent place of stay

③ Departure date, number of nights, number of people

④ Accommodation fees

⑤ Any other matters deemed necessary by the Embassy.

 

2. If a Guest requests, during his/her stay, to extend his/her stay beyond the accommodation date specified in item 1 of the preceding paragraph, our company will consider that a new Accommodation Contract has been entered into at the time such request is made.

 

3. We do not allow minors to stay alone.

Article 3: Establishment of Accommodation Contracts, etc.

1. An accommodation contract shall be concluded when the Company accepts the application as described in the preceding article. However, this shall not apply when the Company proves that it did not accept the application.

 

2. When an accommodation contract has been concluded in accordance with the provisions of the preceding paragraph, we will specify the period and request payment of an application fee up to the accommodation fee for the period of accommodation.

 

3. If the application fee set forth in the preceding paragraph is not paid by the date specified by our company in accordance with the provisions of the same paragraph, the accommodation contract will become void.

 

4. The application fee under Paragraph 2 will be applied in the following order, and any remaining balance will be returned at the end of the accommodation period.

① Accommodation fees to be paid by the guest

② Penalty charges in the event that the provisions of Article 5, Paragraph 2, Article 6, Paragraph 2, and Article 14 apply

③Compensation in the case described in the previous paragraph

Article 4 Refusal to Conclude an Accommodation Contract

1. Our company may refuse to enter into an accommodation contract in the following cases. However, this does not mean that our hotel may refuse accommodation in cases other than those listed in Article 5 of the Inns and Hotels Act.

①When an application for accommodation does not comply with these terms and conditions.

② When the hotel is fully booked and there are no rooms available.

③ When the person seeking accommodation is deemed to be in danger of engaging in conduct that will violate the provisions of the law, the public order, or good morals in regard to his/her accommodation.

④When the person seeking accommodation is deemed to fall under any of the following items (a) to (c):

(a) An organized crime group as defined in Article 2, paragraph 2 of the Law Concerning Prevention of Unjust Activities by Organized Crime Group Members (hereinafter referred to as an "organized crime group"), an organized crime member as defined in Article 2, paragraph 6 of the same Law (hereinafter referred to as an "organized crime member"), an associate member of an organized crime group, or a person related to an organized crime group, or other anti-social forces.

(b) When a corporation or other organization whose business activities are controlled by an organized crime group or an organized crime member

(c) A corporation in which any of its directors is a member of an organized crime group.

⑤When a person seeking accommodation behaves in a manner that causes significant inconvenience to other guests.

⑥ If the person who wishes to stay at the hotel is infected with a specific infectious disease as stipulated in Article 4-2, Paragraph 1, Item 2 of the Hotel Business Act

When the person is a patient (hereinafter referred to as a "patient of a specific infectious disease").

7) When violent demands are made in relation to accommodation, or when an unreasonable burden is requested (excluding cases where the person seeking accommodation requests the removal of social barriers pursuant to Article 8, Paragraph 2 of the Act on Promotion of Elimination of Discrimination against Persons with Disabilities).

8. If the person who wishes to stay at the hotel feels that the burden of such accommodation is excessive and that the hotel is unable to accommodate them at other accommodation facilities,

as a request that is likely to significantly impede the provision of accommodation services to

When the offender repeats the offense specified in Article 5-6 of the Enforcement Regulations of the Inns and Hotels Act.

9. When it is impossible to provide accommodation due to natural disasters, malfunctions of facilities, or other unavoidable reasons.

10) When the circumstances fall under any of the provisions of Article 7 of the Kumamoto City Hotel and Inn Business Act Enforcement Ordinance.

Article 5 Cancellation of Accommodation Contract by the Guest

1. The Guest may cancel the Accommodation Contract by notifying our company.

 

2. In the case where the Guest is staying for personal use (other than long-term or group use as provided for in Paragraph 3), and the Guest cancels the Accommodation Contract in whole or in part, our company will charge a penalty as follows:

① If cancelled 4 days before the stay: None

② If the reservation is cancelled within 3 days before the stay date or if the reservation is not delivered without notice

100% of the accommodation fee

 

3. In the case of a long-term guest (referring to a case where the number of consecutive nights used at the time of booking is 7 or more, regardless of the number of rooms used) or group (referring to a case where the number of rooms used at the time of booking is 3 or more, regardless of the number of nights), when the guest cancels the whole or part of the accommodation contract (a total of 3 or more rooms (1 night or more in the case of long-term stay of less than 3 rooms)), we will charge a penalty as set forth below (if a partial cancellation is made in multiple installments, the following provisions will apply based on each cancellation date).

① If cancelled 31 days prior to the stay: None

② If cancelled between 30 and 21 days prior to the stay, 65% of the accommodation fee

3) If cancelled between 20 and 11 days before the date of stay, 75% of the accommodation fee

④ If cancelled between 10 and 4 days before the date of stay: 80% of the accommodation fee

⑤ If the reservation is cancelled within 3 days before the stay date or if the reservation is not delivered without notice

100% of the accommodation fee

 

4. If a Guest does not arrive by 12:00 p.m. (0:00 a.m. the following day) on the day of accommodation, or if the check-in time requested by the Guest in advance is after 12:00 p.m. (0:00 a.m. the following day) and the Guest arrives later than said time, our company may consider the accommodation reservation to be cancelled.

 

5. In the event that the contract is deemed to have been cancelled in accordance with the provisions of the preceding paragraph, and the Guest proves that his/her non-arrival and non-delivery of public transport such as a train or airplane, or other cause not attributable to the Guest, the cancellation charge stipulated in paragraph 2 will not be charged.

 

6. When a Guest has made a reservation for accommodation through a reservation site operated by a company other than our company, the Guest shall be treated in accordance with the cancellation policy of each such site, notwithstanding the provisions of Paragraphs 2 and 3.

Article 6 Exemption from Penalty Charges

1. Notwithstanding the provisions of the preceding article, if a guest cancels a reservation for accommodation due to any of the following reasons, the Company will not charge a penalty. However, if the guest does not contact the Company by the day of the scheduled stay, the Company will treat the cancellation as a no-show and charge a penalty.

1) If you have a serious and sudden illness that requires hospitalization and you can provide a doctor's certificate

② When a family member within the third degree of kinship passes away and you need to attend a funeral, etc.

3) If a disaster causes public transportation or the means of transportation you use to be unavailable.

Article 7 Termination of Contract by the Company

1. Our company may cancel the accommodation contract in the following cases.

1. If the guest violates these terms and conditions or the terms of use established by our company.

② When the guest is deemed to be in danger of engaging in conduct that violates the provisions of the law, the public order or good morals in regard to his/her accommodation, or when the guest is deemed to have engaged in such conduct.

③ If the guest is deemed to fall under any of the following items (a) to (c):

(a) Organized crime group, organized crime group member, associate member of an organized crime group, or related person to an organized crime group or other antisocial forces

(b) When a corporation or other organization whose business activities are controlled by an organized crime group or an organized crime member

(c) A corporation in which any of its directors is a member of an organized crime group.

④ If the guest behaves in a manner that causes significant inconvenience to other guests.

⑤If the guest is clearly recognized as having an infectious disease.

⑥ If violent demands are made regarding the accommodation, or if an unreasonable burden is requested.

7) If we are unable to provide accommodation due to a natural disaster or other force majeure event.

8. If a reservation deposit has been requested under Article 3 Paragraph 2 and payment has not been made by the deadline.

9. If you do not comply with the prohibitions set forth in the Terms of Use established by our company.

10. When the case falls under any of the provisions of Article 7 of the Kumamoto City Hotel and Inn Business Law Enforcement Ordinance.

⑪ Any other case in which the Company determines that there is a reason similar to any of the preceding items, or that there has been a violation of the Hotel Usage Regulations.

 

2. When our company has cancelled the Accommodation Contract in accordance with the provisions of the preceding paragraph, the Guest shall pay a penalty for all services, etc. which he has not yet received, in accordance with the standards set out in Paragraphs 2 and 3 of the preceding Article.

Article 8 Accommodation Registration

1. On the day of accommodation, upon arrival at the hotel, the guest will be required to register the following particulars in the manner specified by our company:

① Name, address, date of birth, phone number, email address, occupation

② For those who are not Japanese nationals, nationality, passport number, previous and subsequent place of stay

③ Departure date, number of people, departure time

④ Any other matters deemed necessary by the Embassy.

Article 9. Room Occupancy Hours

1. Guests may use the guest rooms of our hotel from 3:00 p.m. to 11:00 a.m. the following morning. However, in the case of consecutive stays, guests may use the rooms all day, except on the days of arrival and departure.

Article 10 Payment of Fees

1. Payment shall be made by credit card at the time of application for the accommodation contract.

 

2. All payments incurred after arrival at the Hotel must be made by cashless payment method designated by our company.

 

3. Accommodation fees will be charged even if the Guest voluntarily does not stay in the accommodation facility after the Hotel has provided the guest room to the Guest and made it available for use.

Article 11: Compliance with Terms of Use

1. Guests must observe the following prohibitions and precautions. If a violation of these rules is confirmed, we may ask the guest to leave the hotel. In this case, we will not refund the accommodation fee.

・Smoking is strictly prohibited inside the rooms, including on the balconies.

・Please refrain from using hot plates or portable stoves to cook meat or other items as this may cause odors and fires.

- Please be mindful of noise both inside and outside your room as it may disturb other rooms and neighbors.

・Please refrain from entering the rooms unless you are a guest staying at the hotel.

・If any equipment within the facility is damaged or soiled, please be sure to contact us. Any acts of destruction within the building or rooms are prohibited.

・We do not have a parking lot at our hotel. If you are driving, please refrain from illegal parking and be sure to use nearby paid parking lots.

・Please refrain from bringing pets into the hotel.

・The use of fireworks, bonfires, and other open flames is prohibited on the hotel grounds.

・All illegal and criminal activities are prohibited on the hotel premises.

・Commercial use such as photography is prohibited without permission from our company. If you wish to use the content for commercial purposes, please contact us in advance.

Article 12 Company Responsibility

1. When our company has caused damage to a guest in the fulfillment or non-fulfillment of the accommodation contract and related agreements, we will compensate for the damage. However, this shall not apply when such damage is due to reasons not attributable to our hotel.

Article 13 Handling when contracted rooms cannot be provided

1.When our company is unable to provide a contracted room to a Guest, we will, with the Guest's consent, arrange accommodation of the same standards elsewhere for the Guest as far as possible.

2. Notwithstanding the provisions of the preceding paragraph, if the hotel is unable to arrange other accommodations for the guest, the hotel shall pay the guest a compensation fee equivalent to the breach of contract charge, which shall be applied to the amount of damages. However, if the hotel is unable to provide a room due to reasons beyond the hotel's control, the hotel shall not pay the compensation fee.

Article 14 Luggage storage and storage of lost property

1. As our hotel is a simple lodging facility without a front desk, we are unable to store guests' luggage. Guests are responsible for managing their own luggage.

2. If the baggage or belongings of a guest are left behind at our hotel and the owner is identified, our hotel will contact the owner and ask for instructions. However, if there is no instruction from the owner or the owner is not identified, we will handle it in accordance with the Lost Property Law.

Article 15 Liability of the Guest

1. When our company suffers damage caused by the Guest's intention or negligence, the Guest shall compensate our company for the damage.

Article 16 Use of Free Wi-Fi

1. Guests are responsible for their own use of the free Wi-Fi in the hotel. Our company shall not be held responsible for any damage suffered by guests as a result of using the free Wi-Fi, or if the service is interrupted due to a system failure or other reasons.
2. If damage is expected to occur or has occurred to our company or a third party due to any act that our company determines to be inappropriate in using the Free Wi-Fi, we will charge you an amount equivalent to the damage.

Article 17 Changes to these Terms

1. The contents of these Terms and Conditions may be changed without prior notice for matters not specified in these Terms and Conditions or when deemed necessary for the conduct of business.
2. In the event of any change to these Terms and Conditions as described in the preceding paragraph, the Company will post on its website the fact that the Terms and Conditions are being changed, as well as the content of the changed Terms and Conditions and their effective date, at least two weeks prior to the effective date of the changed Terms and Conditions.

Article 18 Governing Law

1. These Terms and Conditions shall be governed by the laws of Japan.

Article 19 Jurisdiction

1. In the event of a dispute between a Guest and our company regarding these terms and conditions, the Kumamoto District Court shall be the exclusive court of first instance.
